Privacy Policy 

  1. Introduction 

This Policy applies to MB Superstore Pty Ltd trading as Finance Beagle ABN 36 010 604 350 ("Finance Beagle", "we", "our"). 

Finance Beagle is committed to protecting the privacy of our customers, employees, and partners, and to complying with the Australian Privacy Principles under the Privacy Act 1988 (Cth) ("Privacy Act") and other applicable laws. 

The purpose of this Policy is to inform individuals about the manner in which Finance Beagle collects and manages personal information. 

This Policy will appear on Finance Beagle's website and copies of this Policy will be made available free of charge to any person who requests it.

2. Personal information 

2.1 What is personal information? 

Personal information is defined in the Privacy Act as information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not. 

Personal information can include sensitive information.  Sensitive information is defined in the Privacy Act as information or an opinion about a person's race, ethnic origin, political opinions, membership of political associations and trade associations, religious or philosophical beliefs, sexual orientation or practices, criminal record, health information, genetic information about an individual that is not otherwise health information, biometric information that is used for the purpose of automated biometric verification or biometric identification and biometric templates. 

Personal information can also include credit information. 

2.2 What kinds of personal information are collected and held by Finance Beagle? 

We collect personal information to enable us to provide our products and services to you and otherwise as set out in this Privacy Policy.  In addition, if we are required to comply with certain legislation to provide you with the products and services you choose, then collection of certain personal information will be mandatory.  If you do not want to or are unwilling to provide us with the information we need, we may be unable to provide services to you. 

Examples of the kinds of personal information that may be collected by Finance Beagle include: 

  • name, date of birth, address, telephone number, email address or other contact details; 
  • information that we require to identify customers or loan applicants, including as required under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), which may include details or copies of passports, birth certificates, driver licences, utility bills or other documentary evidence of applicants’ identities; 
  • information relevant to the financial services that we provide or have been requested to provide, including information about customers' or applicant's financial position, such as: details of assets and liabilities, including investments and any existing debts; 
  • details of income, including employment status, occupation and the name of your employer;  
  • proof of financial position, including for example pay slips or tax statements; 
  • other details relevant to a finance application that we require to assess that application, such as family details or the number of dependants; 
  • credit information, including credit information contained in credit reports from Credit Reporting Bodies; 
  • records of our interactions with you, including by telephone, email and online; 
  • your enquiries or complaints; 
  • information that may be required about other third parties (e.g. your spouse, a co-borrower or dependents). Where we collect such information, you confirm that you have obtained the necessary consents from that third party to disclose such information to us and have informed the third party of the purpose of disclosure; 
  • communication preferences (e.g. consent to SMS, email or call);  
  • CCTV footage if you visit our premises; 
  • information about your activity on our website; 
  • information about the IP address and device that you use to access our website; and 
  • information provided as part of an application for employment including education, experience and references. 

Credit information is personal information that relates to credit that a person has applied for or has been provided.  The credit information that we will collect from you may include your records of credit that you have applied for (including the name of the credit provider, the type of credit and the amount of credit), default information or any other information that has a bearing on your credit worthiness used to determine your eligibility for credit.  Credit information also includes credit reporting information supplied to us by a credit reporting body and any information that we derive from it.  For more information about the ways that credit information and credit eligibility information is handled by us, please refer to our Credit Reporting Policy at the end of this document.  

We may also collect and hold sensitive information about you, including information relating to:  

  • your citizenship or country of birth; 
  • biometric information to be used for the purpose of identification or automated biometric verification; 
  • criminal records; and 
  • information where you are a politically exposed person under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).  

2.3 How does Finance Beagle collect and hold personal information? 

Finance Beagle collects personal information from: 

  • individuals directly; 
  • our brokers or credit representatives; 
  • any business which provides information about consumers or commercial creditworthiness of persons; 
  • a credit report obtained from a credit reporting body; 
  • any sources disclosed in your application for finance such as employers (past and present), landlords, etc; 
  • service providers that assist in the processing of applications; 
  • any joint applicants, co-applicants or guarantors or proposed joint applicants, co-applicants or guarantors in relation to an application for finance; 
  • referrers, credit providers, insurance product providers; 
  • our agents, contractors and external advisers; 
  • Government authorities (e.g. tax authorities in Australia and overseas) in connection with their lawful information requests or to meet legal obligations in any relevant jurisdiction; 
  • our related bodies corporate; 
  • issuers of identification documents via the use of third-party systems; 
  • intermediaries, including your agent, adviser, a dealer, a broker, a representative acting on your behalf, other Australian Financial Services Licensee or our authorised representatives and advisers and our agents; 
  • mortgage insurers to assess the risk of providing mortgage insurance or to assess the risk of default; 
  • accounting or finance specialists; 
  • legal and other professional advisers; 
  • debt collection agencies; 
  • your guarantors; 
  • organisations involved in valuing, surveying or the like; 
  • referees that you may provide in support of an application for employment; and 
  • from public records and other publicly accessible sources. 

Upon request, we will provide you with the source of your personal information, unless it is impracticable or unreasonable to do so. 

2.4 Cookies 

Finance Beagle may use "cookies", traffic measurement software or similar technologies to collect data.  Most cookies will only collect de-identified personal information.  However, some cookies do collect personal information.  

Cookies used on our website can collect the following information from users: 

  • IP address; 
  • device type and browser; 
  • pages viewed and time spent; 
  • click behaviour; 
  • referring websites; and 
  • location approximated from your IP address. 

We use this information to: 

  • improve website functionality and user experience; 
  • analyse performance and diagnose technical issues; 
  • understand customer interests and website traffic patterns; 
  • provide relevant marketing and advertising; and 
  • support online enquiries, test drive bookings and digital forms. 

If you do not want information to be collected through the use of cookies or traffic measurement software, your device and/or browser may enable you to delete or "turn off" cookies or some the measurement software features.  However, some or all parts of our website may not function correctly if such features are disabled. 

3. Use, disclosure & purpose 

3.1 The purposes for which Finance Beagle collects, holds, uses and discloses personal information 

Finance Beagle may collect, hold, use and disclose personal information for the following purposes: 

  • to assess a customer’s suitability for a loan or financial product; 
  • to provide finance to customers through our network of lenders; 
  • to send customers marketing about other products and services that we think may be of interest to them; 
  • to operate our website; 
  • to provide you with quality products and/or services and to improve how we operate and provide those services; 
  • to assess an application for finance to ensure no financial hardship will occur because of assisting with the provision of a specific loan; 
  • to arrange finance and any related insurance; 
  • to maintain your contact details; 
  • to fulfill our legal obligations under applicable laws and rules, such as those relating to anti-money laundering and counter-terrorism financing; 
  • to provide you with information about products or services offered by us; 
  • to respond to your requests, inquiries and complaints; 
  • to contact individuals, via email, regular mail, telephone or otherwise;  
  • to provide you with information that we believe may be of interest to you or that you have requested; 
  • to support marketing and communications; 
  • to develop and improve our products, services and content; 
  • to protect our rights and property; 
  • for security and occupational health and safety purposes; 
  • if you have applied for a job with us, to assess your suitability for the role, including verification of your identity, qualifications, certifications and entitlement to work, and we may also conduct background or criminal history checks; 
  • to investigate or report suspected unlawful activity; 
  • to protect someone's life, health, safety or welfare; and 
  • to comply with a law or regulation, or a court order or other legal process. 

Finance Beagle never uses any sensitive information for direct marketing purposes. 

3.2  Disclosure of personal information to other parties 

Finance Beagle may disclose personal information to other individuals and organisations, such as: 

  • any business which provides information about consumers or commercial creditworthiness of persons; 
  • any sources disclosed in your application for finance such as employers (past and present), landlords, etc; 
  • service providers that assist in the processing of applications; 
  • brokers; 
  • any joint applicants, co-applicants, guarantors or proposed joint applicants, co-applicants, guarantors in relation to an application for finance; 
  • referrers, credit providers, insurance product providers; 
  • our agents, contractors and external advisers; 
  • our related bodies corporate; 
  • issuers of identification documents via the use of third-party systems; 
  • intermediaries, including your agent, adviser, a dealer, a broker, a representative acting on your behalf, other Australian Financial Services Licensee or our authorised representatives, advisers and our agents; 
  • mortgage insurers to assess the risk of providing mortgage insurance or to assess the risk of default; 
  • accounting or finance specialists; 
  • legal and other professional advisers; 
  • debt collection agencies; 
  • your guarantors; 
  • organisations involved in valuing, surveying or the like; 
  • our external dispute resolution service; 
  • law enforcement officers, regulators, courts and government agencies, if permitted or required: 
  • by law, regulation, court order or other legal process; 
  • to assist in the prevention or detection of crime, or where a test drive vehicle or loan vehicle is involved in any parking or traffic infringements or is damaged while in your possession; or 
  • to prevent a threat to any person's life, health or safety; and 
  • any purchaser or prospective purchaser of or investor in our business, including in the case of bankruptcy, a merger, acquisition, reorganisation, sale of assets or shares, or due diligence in respect of any such transactions. 

3.3 Disclosure outside of Australia 

Our servers are hosted in Australia. 

Additionally, we are likely to disclose personal information to our related entities and bodies corporate in the United States of America and Philippines, and to our service providers and other third parties in India, Singapore, the United States of America, the Philippines, Fiji, and South Africa.  We take reasonable steps to protect personal information that is disclosed overseas including through vendor diligence and imposing contractual obligations. 

We may also need to send your information overseas to process transactions you have instructed us to make, such as international money transfers. The countries to which we disclose your information will depend on the transaction details. 

You consent to any disclosure of your personal information outside of Australia on the understanding that if the overseas recipient handles the personal information in breach of the Australian Privacy Principles, the entity will not be accountable under the Privacy Act, and you will not be able to seek redress under the Privacy Act.  The overseas recipient may not be subject to privacy obligations or any principles similar to the Australian Privacy Principles.  Individuals may not be able to seek redress in some overseas jurisdictions, and overseas recipients may be subject to a foreign law that could compel the disclosure of personal information to a third party, such as an overseas authority. 

3.4 Government related identifiers 

Finance Beagle does not use any government related identifiers, such as passport number or driver's licence number, as its own identifier of any individual.  Finance Beagle will not use or disclose any government related identifiers other than in accordance with the Privacy Act. 

3.5 Data integrity and security 

Finance Beagle takes reasonable steps to ensure that the personal information that it collects, uses and discloses is accurate, up-to-date and complete.  We encourage individuals to assist us with this by contacting us if you are aware that any of your personal information is not accurate, up-to-date or complete. 

Finance Beagle takes reasonable steps to protect personal information it holds from misuse, interference and loss, as well as unauthorised access, modification or disclosure.  We store your personal information in several ways, including in physical paper files and electronic systems and devices.  Much of the information we hold is stored electronically on servers that are in company premises or in secure data centres located in Australia.  Access to and use of this information within our related bodies corporate is appropriately limited to protect from misuse or unlawful disclosure of the information 

When Finance Beagle no longer requires personal information for any purpose for which the information may be lawfully used or disclosed under the Australian Privacy Principles, we take reasonable steps to destroy the information or ensure that it is de-identified, except if the information is part of a Commonwealth record or Finance Beagle is required by law or a court or tribunal order to retain the personal information. 

3.6 Sensitive information 

If you provide us with sensitive information about other individuals, such as sexual orientation or health information, please ensure that the individual or the individual's representative is aware of the disclosure and that he or she consents to the disclosure to Finance Beagle as well as to the handling of their personal information in accordance with this Policy.  Otherwise you must not provide us with any sensitive information about other individuals. 

3.7 De-identified data 

You consent to us using and disclosing your de-identified data (information that no longer identifies you) for any purpose, including, without limitation, statistical analysis, product or service development, marketing and business planning or any other commercial purpose.  We undertake technical measures to ensure that this data cannot be associated back to you. 

3.8 Marketing 

We may use and disclose your personal information to inform you about other products and services we think may be of interest to you in the future. 

To opt out of receiving direct marketing communications from us, or to request that we do not disclose any of your personal information for the purpose of facilitating direct marketing by other organisations, please notify our Privacy Officer in writing and we will remove you from our marketing database.  The contact details for our Privacy Officer are provided below. 

4.0 Automated decision-making systems 

In limited circumstances, we may process your personal information using semi or fully automated decision-making systems, being any computer program or artificial intelligence, to make, or do something that is substantially and directly related to making a decision that could significantly affect the rights or interests of an individual. e.g. using a copy of your driver's licence to upload into ID confirmation or verification software to affirm your identity.  

5.0  Access and correction  

Individuals have a right to request access to their personal information and to request its correction.  To do so, please contact the Privacy Officer.  Contact details are provided below.  

Finance Beagle does not impose a charge for making a request for access.  However, we may charge for reasonable administrative costs incurred in providing access. 

Finance Beagle encourages individuals to advise our Privacy Officer if your personal information requires correction or updating.  Finance Beagle does not impose any charge with respect to requests for correction or updates. 

Before correcting or providing access to personal information in response to a request, Finance Beagle will require your identity to be confirmed. 

Requests for access or correction may be refused upon the grounds contained in the Privacy Act.  If we refuse to provide access, or to correct personal information, Finance Beagle will provide you with reasons for the refusal.  

6.0 Complaints 

A person who wishes to complain about a breach of the Australian Privacy Principles by Finance Beagle should contact our Privacy Officer. 

Finance Beagle will not impose any charge for making a complaint, or for dealing with the complaint.  Once a complaint has been lodged, our Privacy Officer will acknowledge its receipt to you as soon as possible. 

We will do our best to ensure that our investigation is completed, and a decision on your complaint is communicated to you, within 30 days from our receipt of the complaint.  We will contact you if we need more time. 

You may also contact the Office of the Australian Information Commissioner.

9.  Status of this Policy 

This Policy may be varied by Finance Beagle from time to time.   

This Policy does not create any legally enforceable obligations on the part of Finance Beagle and does not grant to any individual any rights beyond the rights created under the Privacy Act.
